Zoning Board of Appeals
The Village of Woodbury Zoning Board of Appeals reviews applications from property owners for special permits variances. When there are practical difficulties or hardships faced by individual property owners in complying with the strict letter of the Village's zoning regulations, the Zoning Board of Appeals has the authority to issue special permits and/or variances, provided the public convenience, safety and welfare are substantially served and the integrity of neighboring properties are not injured.
The Zoning Board of Appeals meets on the second Wednesday of each month at 7:30PM in Woodbury Town Hall, 511 Route 32, Highland Mills. Agendas are set prior to each meeting and posted here. Meeting minutes are prepared following each meeting and are available in hardcopy at the Building Department or electronically.

4. Action on Decisions –
a. Crosby – Review decision for an area variance to permit the installation of a 6 feet high solid vinyl stockade fence in a side yard, whereas, pursuant to Village code section 146-5B, a maximum of 4 feet high is permitted. Said property is located in the HB Zoning District at 531 Route 32 in Highland Mills and is known on the Village of Woodbury Tax Maps as Section 219 Block 5 Lot 9.
b. Patterson/Hunter - Review decision for a Special Permit to permit the continued use of a 2nd dwelling unit for an individual family members (mother/daughter) pursuant to Section 310-35 of the Village Code. Said property is located in the R3A Zoning District at 1155 Route 32 in Highland Mills and is known on the Village of Woodbury Tax maps as Section 201 Block 1 Lot 26.
5. Public Hearings -
A) The Shops of Woodbury, LLC – Continuation of Public Hearing for an interpretation pursuant to section 310-49(c)3. The applicant requests an interpretation of 310-6f, 310-7 to determine if a hotel is permitted as part of a commercial center. Furthermore, the applicant requests an interpretation as to whether the proposed hotel meets the required frontage as defined in section 310-2. Said property is located in the IB Zoning District on Locey Lane in Central Valley and is known on the Village of Woodbury Tax Maps as Section 225 Block 1 Lot 34.1 & 34.2.
B) Osweiller – WITHDRAWN BY APPLICANT - Continuation of Public Hearing for a use variance and modification of an existing special permit pursuant to Section 310-43.2(B)3. Whereas said commercial warehouse and distribution uses are not a permitted use in the R0.25A Zoning District. No exterior modifications to the building or site are proposed. Said property is located in the R0.25A Zoning District at 19 Adams Street in Highland Mills and is known on the Village of Woodbury Tax Maps as Section 220 Block 2 Lot 15.1.
C) Highland Lakes Estates Homeowners Association – Public Hearing for an area variance to permit the installation of a 6ft high chain link fence along the North West property line. Pursuant to Section 146-5A & B, a 6ft high fence is only permitted in a rear yard. Said property is located in the R2A Zoning District within the Highland Lakes Estates subdivision and is known on the Village of Woodbury Tax maps as Section 245 Block 1 Lot 179.
D) Kucharczyk Public Hearing for an area variance to permit the installation of a 6 ft. high solid chain link fence in a front yard. Pursuant to Section 146-5b and 146-7a, a 6ft high solid fence is not permitted in a front yard. Said property is located in the R3A Zoning District at 1 Trout Brook Rd in Highland Mills and is known on the Village of Woodbury Tax maps as Section 201 Block 1 Lot 19.2.
E) Woodview Heights/39M LLC – Public Hearing for an area variance. Pursuant to Section 310-2(1)C the definition of lot area requires steep slopes deducted from the overall lot area calculations in the number of lots that may be approved. The applicant is seeking approval for a 14 lot subdivision (Woodview Heights) and is requesting that the steep slopes not be deducted from the lot area requirements which would reduce the overall lot count of the proposed subdivision. Said property is located in the R1A Zoning District at the corner of Hill Avenue and Van Buren Court in Highland Mills and is known on the Village of Woodbury Tax maps as Section 204 Block 1 Lot 34.
